It is common practice for insurance company adjusters to engage in almost any tactic to delay or prevent the settlement of personal injury claims assigned to them. However, an experienced New Jersey personal injury attorney will be able to identify these delay tactics and take certain measures to properly deal with it and further settlement talks or to prevent the delay tactics altogether.
Three of the most common delay tactics adjusters use to stonewall their claims are discussed below.
Unfair Leveraging
One way for an adjuster to delay the settlement of a claim is to refuse to pay out on one part of a multi-part claim until you agree to settle all parts of your case. The adjuster’s goal in this tactic is to force you into a corner in order to prematurely settle another part of the claim that you need to deal with more quickly.
Health Insurance Coverage
Another tactic is to force you to use your own health insurance coverage, assuming you have one, to pay for your medical bills. The adjuster will then take credit for that coverage and not count it as part of the settlement figure.
Financial Weakness
In most personal injury cases, claimants are generally at more of a financial disadvantage than the insurance carrier, giving the carrier an upper hand during negotiation talks. In other words, if the adjuster knows that you are financially vulnerable and need the settlement quickly to pay bills or any other expenses, they will try to pressure you to settle for less than the value of your case because you have no other option.
