What Damages Can I Recover After a Motorcycle Accident in Elizabeth?

Motorcycle Accidents

A motorcycle crash in Elizabeth can leave you dealing with injuries that affect far more than your medical bills. You may be unable to work, need months of treatment, lose the use of your bike, or live with pain and physical limitations that change how you handle everyday life.

If someone else caused the crash, you may be entitled to compensation for both the financial losses you can document and the personal harm the accident caused. Below, Beninato & Matrafajlo Attorneys at Law, LLC explains what damages may be available, what can affect the value of your claim, and how a lawyer can fight for a recovery that reflects the full impact of your injuries.

Medical Expenses After an Elizabeth Motorcycle Accident

You may be able to recover medical expenses caused by the crash, including emergency care, hospitalization, surgery, diagnostic testing, medication, rehabilitation, physical therapy, medical equipment, and follow-up treatment.

Future medical costs may also be recoverable when the evidence shows that additional treatment is reasonably expected because of the motorcycle accident. An orthopedic, spinal, or neurological injury may require future surgery, specialist care, therapy, or assistive equipment.

Motorcycle insurance works differently from automobile insurance in New Jersey. N.J.S.A. § 39:6A-2 does not include a motorcycle within its definition of an “automobile,” and N.J.S.A. § 39:6A-4 requires basic PIP benefits for certain injuries involving automobiles. This means that basic automobile PIP generally does not cover you simply because you were injured while riding a motorcycle, so you may need to rely on other available insurance or pursue your medical expenses from the at-fault party.

Lost Wages and Reduced Future Earning Capacity

If your motorcycle injuries prevent you from working, you may seek compensation for income you lost during your recovery. Depending on your employment, that can include wages, salary, commissions, overtime, or other earnings.

A lasting injury can also reduce your future earning capacity. You may be unable to return to the same job, perform the same duties, work the same hours, or pursue expected advancement. When an injury affects your long-term ability to earn, medical, vocational, or economic evidence may be needed to prove that loss.

Motorcycle and Property Damage

You may also seek compensation for damage to your motorcycle and personal property. If the motorcycle can be repaired, the claim may include repair costs. If it is a total loss, damages may be based on the motorcycle’s fair market value before the collision.

Your claim may also include damaged riding gear, a helmet, electronics, towing, storage, and accident-related expenses. Photographs, estimates, invoices, and receipts can help document these losses.

Pain, Suffering, and Loss of Enjoyment of Life

Under N.J.S.A. § 39:6A-2, you may seek compensation for noneconomic losses such as pain, suffering, and inconvenience. For an injured motorcyclist, those losses may include chronic pain, physical limitations, scarring, sleep problems, loss of independence, and difficulty participating in work, hobbies, or everyday activities.

New Jersey’s limitation-on-lawsuit option can restrict when some riders recover noneconomic damages. If the limitation applies to you, N.J.S.A. § 39:6A-8 generally requires an injury such as a displaced fracture, significant scarring or disfigurement, loss of a body part, or permanent injury before you can recover pain-and-suffering damages. Whether that limitation applies depends on your automobile insurance status and coverage—not simply on the fact that you were riding a motorcycle.

How Comparative Fault Can Reduce Your Damages

Your compensation may be reduced if you were partly responsible for the collision. N.J.S.A. § 2A:15-5.1 allows recovery when your negligence is not greater than the negligence of the person, or combined persons, from whom you seek damages. The law then reduces your award by your percentage of fault.

For example, if your recoverable damages are $200,000 and you are found 20 percent at fault, your recovery would generally be reduced to $160,000. If your share of negligence is greater than the combined negligence of the parties from whom you seek recovery, you cannot recover damages.

Punitive Damages in Exceptional Cases

Punitive damages are different from compensation for your actual losses. Under N.J.S.A. § 2A:15-5.12, you may seek punitive damages when clear and convincing evidence shows that the defendant acted with actual malice or willful disregard for people who could foreseeably be harmed. Even gross negligence by itself is not enough.

If punitive damages are awarded, N.J.S.A. § 2A:15-5.14 generally caps them at five times the compensatory damages or $350,000, whichever is greater. That cap does not apply in certain cases, including when the defendant has been convicted of driving under the influence in connection with the conduct at issue.

Damages After a Fatal Elizabeth Motorcycle Crash

If an Elizabeth motorcycle accident causes death, the family may have two different claims. A wrongful death claim seeks compensation for the financial losses caused by the death, such as lost support, lost household services, and qualifying medical or funeral expenses. N.J.S.A. § 2A:31-5 allows these damages based on the financial harm suffered by surviving beneficiaries.

A separate survival claim belongs to the deceased person’s estate and covers losses the person suffered before death. Under N.J.S.A. § 2A:15-3, that can include damages that arose between the injury and death, including conscious pain and suffering, along with funeral and burial expenses.

The damages available after an Elizabeth motorcycle accident may include medical expenses, future treatment, lost income, reduced earning capacity, motorcycle and property damage, pain and suffering, and, in exceptional cases, punitive damages. Fatal crashes may also support wrongful death and survival damages.
