In order for the Second Injury Fund to apply, your lawyer will need to file a motion directed to the Division of Workers’ Compensation. In order for the Fund to consent to being joined, you will need to provide sufficient medical reports that clearly indicate the basis upon which you contend that you qualify. Typically, the more details you provide, the easier it will be to convince the Fund to consent to joining.
Once the consent order joining the Fund is signed and filed with the Court, you will need to sign a verified petition, making a claim against the fund.
