Upon arrival at the scene, responding officers reported a strong odor of alcohol and observed an open container of vodka under the driver’s seat. K.M.A. was subsequently charged with:
Operating Under the Influence (39:4-50).
Reckless Driving (39:4-96).
Failure to Maintain Lane (39:4-88B).
Following the arrest, K.M.A. was transported to police headquarters where breath samples yielded a 0.138% BAC, significantly above the legal limit.
