Six traits that make up some of the Best Personal Injury Lawyers?
If you are injured due to the negligence of someone else, choosing the right personal injury lawyer can be a daunting task. Every day, people are bombarded with hundreds of self-serving attorney advertisements. The decision of which personal injury lawyer to retain can feel very intimidating. We all see the billboards and TV ads with catchy slogans like, “we win at all costs,” “we are the best personal injury lawyers”, or “we are the best automobile accident attorneys”. Those billboards and TV advertisements should make you ask, “Is this personal injury lawyer the best choice for my case?”
There is no secret formula to choosing the right personal injury lawyer. However, there are certain traits that great lawyers share. The more of these traits a lawyer possesses, the greater the likelihood that he or she is among the best.
6 traits of a great personal injury lawyers are:
- A Proven Track Record;
- Commitment to Clients;
- Contingency Fee; and
First and most important is a lawyer’s ability to obtain large recoveries for clients. That does not include large settlements or recoveries for severe or catastrophic injuries. While results are never guaranteed, severe and catastrophic injuries often result in large settlements or verdicts.
The more important results are those an attorney obtains on injuries that are more difficult to evaluate. Difficult injuries tend to be invisible to the naked eye, but a good doctor can diagnose these injuries through sophisticated tools like an MRI or CAT scan. A great lawyer will understand these hidden injuries and have the ability to present these injuries to third parties in a way that maximizes a client’s potential recovery.
For example, an attorney recovering a verdict of more than $1 million dollars for an amputated leg is not unusual or compelling. In fact, such a recovery should almost be expected from a lawyer trying an amputated leg case if there are no issues of who is at fault. However, if an attorney recovers $1 million dollars for a herniated spinal disc without surgery, that recovery is more indicative of greatness.
I purposely do not list large recoveries on severe injury cases, because these recoveries are almost expected. My listed recoveries or trial results are on cases where the injuries where invisible, and not easily quantified or apparent. The recoveries I have secured on these cases are the results you should care about.
PROVEN TRACK RECORD
Occasionally everyone gets lucky. However, a great personal injury lawyer has a proven track record of repeated success. For these attorneys, luck is welcomed but not expected.
Repeatedly obtaining great recoveries requires help—it is rarely an individual effort. My success is the byproduct of my skills and the effort of my trusted team. There are always issues in any case. A great lawyer with a proven track record understands the issues and deals with them directly with the help and support of knowledgeable and committed staff.
At Beninato & Matrafajlo, we understand that that each case is unique, just like every client is a unique individual. We welcome difficult cases with unique challenges; we do not shy away from them. Our track record shows it.
COMMITMENT TO CLIENTS
Commitment to clients must be absolute and consistent. Clients should never be ignored or answered only when it’s convenient. A great lawyer striving to be the best in personal injury law must care about his clients. This commitment requires sympathy, compassion, and involvement from the time the client walks in the door, throughout the treatment process, and all the way to the jury verdict. If the law firm is not committed to its clients, then the ability to obtain large recoveries is hindered. I believe that true commitment to clients is achieved when the law firm or lawyer treats his/her clients as family.
At Beninato & Matrafajlo we treat all of our clients as family. When evaluating a case settlement offer, I routinely ask myself would I advise my brother or mother to accept an offer if he or she was the victim? If the answer is yes, then it’s a fair recovery. If the answer is no, then the recovery is not fair and we must move forward.
An attorney’s reputation is important because the reputation typically precedes the lawyer. A lawyer with a good reputation can develop strong relationships within the courts, is respected by the insurance companies that pay settlements and verdicts, will receive case referrals from other lawyers, and occasionally will be asked to lecture in the field of law.
At Beninato and Matrafajlo, our reputation is well respected in the courts and at insurance companies, we routinely obtain case referrals from other lawyers and are asked to lecture on the topics such as personal injury litigation, or technology in the courtroom, etc.
Be wary of any personal injury lawyer who requests an upfront retainer. Most personal injury lawyers work on a contingency fee basis. In the State of New Jersey, the rate of recovery on a contingency fee basis is dictated by the New Jersey Supreme Court and incorporated into a Rule. If a personal injury lawyer charges less than 33 1/3 percent on a case, then it is a safe bet that lawyer is not truly invested in achieving the best result on your case. That lawyer is banking on volume.
Time is life’s ultimate teacher. A lawyer possessing these listed traits and who has ample experience is a force to reckon with. An experienced personal injury lawyer that cares about clients, employs a staff that understands the issues, and has a reputation for success, is going to be in the best position to get you the recovery you deserve. It’s that simple.
Success is never guaranteed. But, with more than 60 years of combined experience representing the injured, we at Beninato & Matrafajlo understand that continued success requires a constant commitment to learn from other’s mistakes and to capitalize on past victories — the ultimate building blocks of success.
